按摩女遭同事性騷　業者裝傻挨罰3.5萬

北市勞動局性平等日前審議，北市某按摩業雇主因未即時啟動性騷擾防治處理機制而受罰。該案為合法的明眼人按摩業女員工於上班時間，請男同事幫忙按摩紓壓，過程中女認為遭男騷擾，憤而離職；調查該女任職期間未告知雇主此事，雇主收到勞動局公文才知，依法雇主知悉時應即啟動機制，審慎調查並有效糾正及提供補救；本案雇主僅「主觀認知」非屬性騷擾，並推託員工相處關係不好、對公司挾怨報復等，後續也未辦理加強性騷擾防治訓練、宣導等補救措施，裁定雇主違法罰3萬5000元。

依法罰鍰為10萬至50萬元，考量該公司規模，與遭性騷擾的員工是離職後告知雇主，因此減輕罰鍰。此案也是北市首宗按摩業雇主被裁定違反《性平法》。
